By creating an account and using Dsayah ("the Service", "the App", "we", "us", or "our"), you agree to comply with and be legally bound by these Terms of Service. If you do not agree to these terms, you must not use the Service.
These Terms constitute a legally binding agreement between you and Dsayah. We reserve the right to modify these Terms at any time, and your continued use of the Service constitutes acceptance of those changes.

We reserve the right, but have no obligation, to monitor, review, or remove user content that violates these Terms or is otherwise objectionable. We may use automated tools and human moderators for this purpose.
Dsayah uses algorithms to suggest potential matches based on your preferences, location, age, and other factors. We do not guarantee specific results or that you will find a match.
All interactions between users, including chats, voice calls, and video calls, are the sole responsibility of the participating users. Dsayah is not responsible for the conduct of users off the platform or any damages resulting from user interactions.
By using location-based features, you consent to the collection and use of your location data as described in our Privacy Policy. You can control location permissions through your device settings.
Dsayah uses a virtual currency called "Gems" for accessing premium features such as:

All purchases of Gems are final and non-refundable, except as required by applicable law or as otherwise stated in our refund policy. Gems have no monetary value and cannot be exchanged for cash.
Unused Gems will remain in your account unless your account is terminated or closed. We reserve the right to modify gem prices, features, or the gem system with notice.
Payments are processed through third-party payment providers (Google Play, Apple App Store). By making a purchase, you agree to their respective terms and conditions.
All prices are displayed in your local currency as converted by the app store payment processor. Prices are subject to change at any time.
You are responsible for any applicable taxes related to your purchases.

If you encounter inappropriate behavior or content, you can report it through the in-app reporting system. We will review reports and may take action including warning, suspension, or permanent ban of users who violate these Terms.

The Service, including its design, features, graphics, text, and code, is owned by Dsayah and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service.
The Dsayah name, logo, and related marks are trademarks and may not be used without our prior written permission.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not guarantee that you will find a match, relationship, or any specific outcome from using the Service.
While we offer a verification system, we do not guarantee that verified users are who they claim to be. We do not conduct background checks on users.
We are not responsible for user-generated content or the accuracy of information provided by users.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DSAYAH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

Upon termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination will remain in effect.
These Terms shall be governed by and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions.
Any dispute, claim, or controversy arising from or relating to these Terms or the Service shall be resolved through binding arbitration, not in court, except where applicable law allows eligible claims to be brought in small claims or similar consumer courts. Arbitration shall be conducted under internationally recognized arbitration rules and the decision shall be final and enforceable in any applicable jurisdiction.
You agree that any arbitration or proceeding shall be limited to the dispute between you and Dsayah individually. CLASS ACTION LAWSUITS, CLASS-WIDE ARBITRATIONS, AND REPRESENTATIVE ACTIONS ARE NOT PERMITTED.

We may modify these Terms at any time. We will notify you of significant changes through the app or via email. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Dsayah.
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
You may not transfer or assign your rights under these Terms without our consent. We may transfer our rights to any affiliate or successor.
